Terms of Use
Who these terms are with
These terms are an agreement between you and Nathan Favier ("Nathan"), who runs Courtside. Using Courtside means you accept them and the Privacy Policy. If you don't accept them, don't use Courtside.
What Courtside is
Courtside keeps a junior tennis tournament weekend in one place for a coach and the families travelling with him: the schedule, live scores, notes, food and water, and what each family owes.
Courtside is not affiliated with or endorsed by the USTA or any tournament. The tournament's official draw, schedule and rules always come first.
These terms cover the app only. Coaching, travel and supervision are arranged separately between Nathan and each family.
Who can use it
- Accounts are for the coach and parents, who must be 18 or older.
- Players do not have accounts. They follow along on a parent's phone.
- You join a weekend with a code from the coach. Keep the team code within your team. Join only for your own child.
Your account
Parents join with the coach's code, with no password and no phone number. The coach signs in with his mobile phone number and a code we text him. Message and data rates may apply. Keep your phone secure. You are responsible for what is done from your account.
What you post
You keep ownership of what you write. You let Nathan store it and show it to the people in your weekend, only to run Courtside.
Keep notes, scores and messages accurate and kind. Never post anything abusive, sexual, threatening or hateful, and never post anything about another family's child beyond their scores. There is zero tolerance for this.
To report something, tell the coach or email nathanfavier03@gmail.com. Reported content is reviewed and removed within 24 hours, and the person who posted it can be removed from the team. The coach can remove anything posted to a weekend.
Payments
Courtside shows what each family owes for coaching and shared costs. It does not take or hold money. You pay the coach directly, by the methods he lists. A bill's status in the app is a record, not a receipt.
Health and safety
Food and water entries and notes are a record, not medical advice. Ask a doctor about heat, hydration, injury or illness. In an emergency, call 911.
Scores and availability
Scores are entered by people at the courts and can be wrong or late. Courtside may be unavailable at times, and features may change or end.
No warranty
COURTSIDE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, INCLUDING ANY WARRANTY OF ACCURACY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, TO THE EXTENT THE LAW ALLOWS.
Limit of liability
TO THE EXTENT THE LAW ALLOWS, NATHAN IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSSES, OR FOR LOST DATA, ARISING FROM THE USE OF COURTSIDE. HIS TOTAL LIABILITY FOR ANY CLAIM ABOUT THE APP IS LIMITED TO 100 US DOLLARS. Some places don't allow these limits, so they may not apply to you.
Ending
You can stop at any time and delete your account in Profile. Nathan can remove access from anyone who breaks these terms or misuses Courtside. The sections on what you post, no warranty, limit of liability and law survive the end of these terms.
Changes to these terms
If these terms change, the date at the top changes. If a change is significant, we will tell you in the app first. Continuing to use Courtside after that means you accept the change.
Law and disputes
These terms are governed by the laws of the State of Texas. If you have a problem, email nathanfavier03@gmail.com first, and we will try to fix it within 30 days. If that fails, either side may bring a claim in small claims court, or in the state or federal courts of Nueces County, Texas.
Apple
If you got Courtside from the App Store, these terms are between you and Nathan, not Apple. Apple has no duty to support the app or to answer claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Apple's Standard Licensed Application End User License Agreement also applies, and if it conflicts with these terms, Apple's terms win for the iPhone app.
The rest
If any part of these terms can't be enforced, the rest still applies. These terms and the Privacy Policy are the whole agreement about the app.
